It may not be seen as a major step, but to many it most certainly will be a major sign of relief. Imagine the difficulties, both mental and financial, that accompanies the trip abroad with under the current immigration regulations. The law states that a person residing illegally in the U.S. for a period greater than one year is barred from reentry for 10 years, but there is a waiver, which until now would take anywhere from six months to more than one year. Separation from family and unable to provide support for such a long time creates an extreme and devastating situation for these families. But under the proposed regulations, the applicants would apply in the U.S. and wait here for a result. If approved they would be granted a provisional waiver. When they go abroad for the interview they should return soon after a medical exam, criminal background verification and a consular interview. This is not much different than the pre-1997 draconian laws which this country has been suffering under. Of course the lawyer that processes the case must be a very experienced and knowledge in order to ascertain the probability of success.
