A 45-year-old Mexican man convicted of sexual assault in Wisconsin was sentenced to 70 months in prison on Nov. 2 for attempting to re-enter the United States, U.S. Customs and Border Protection said Tuesday.

Refugio Alvarez Olivan, 45, of Cuernavaca, Morelos, was arrested by Tucson Sector Border Patrol agents on May 18. A background check found that Alvarez was convicted in 1996 in Sheboygan, Wis., for battery to a child and three counts of second-degree sexual assault, the Border Patrol said.

Alvarez was deported from the United States through Brownsville, Texas, after serving a nine-month sentence.

The Border Patrol sent his current case to the U.S. Attorney's Office for federal prosecution of an aggravated felon, the Border Patrol said.

After serving his sentence, Alvarez will be formally removed from the United States.
