Border Patrol agent arrested for lewd conduct with minor

Pima County Sheriff’s Deputies arrested a Border Patrol agent at the Ajo Station two weeks ago based on a fugitive warrant issued by officials in Imperial County, California for charges of lewd and lascivious acts with a minor in 2013.

Supervisory Agent Kyle Mrofka, 29, is being held without bond at the Pima County jail pending his extradition to Imperial County, which borders Arizona, near Yuma.

Mrofka faces two counts of lewd acts under California law for allegedly having sexual contact with a 14- or 15-year-old child while he was at least 10 years older than the minor. 

According to court records, the charges stem from an incident on May 26, 2013. 

The Yuma Sun reported earlier this month that the alleged acts occurred in the Picacho States Recreation Area, located on the bank of the Colorado River about 22 miles north of Yuma. 

Mrofka is scheduled to appear in Pima County Superior Court for a review hearing, and will face a $75,000 bond in Imperial County. 

Deputies from Pima and Imperial counties served the warrant at the Ajo Station, said a spokesman with the Tucson Sector. 

Mrofka has been with the federal border enforcement agency for nine years, and is presently suspended without pay pending the outcome of the investigation, the spokesman said. 

“The U.S. Border Patrol stresses honor and integrity in every aspect of its mission.  We do not tolerate misconduct on or off duty and will fully cooperate with all investigations of alleged unlawful conduct by our personnel,” the spokesman said.
