A 29-year-old convicted gang member was sentenced to 33 months in prison for illegal re-entry into the United States, U.S. Customs and Border Patrol announced Wednesday.

Jesus Ivan Rodriguez Nevarez, of Durango, Mexico, was sentenced April 3, the Border Patrol said.

Rodriguez was apprehended by Naco Station agents in October. During processing, agents learned he was convicted in Maricopa County in 2006 for leading and inciting participation in criminal street gang activity, including a drive-by shooting and assault, the Border Patrol said.

After serving his sentence, Rodriguez will be formally removed from the United States and will be banned for life from all legalization processes, the Border Patrol said.
