Authorities identify Pima jail inmate dead after fight with officer

An inmate at the Pima County jail is dead after a "use-of-force" incident involving a corrections officer Thursday afternoon, officials said.

David Ray Maxwell, 53, was being held in the jail on $7,500 bond in a Superior Court criminal case, records show. The charges against Maxwell were not immediately available.

The officer involved in the altercation, Jason Hubert, has been a Pima County Sheriff's Department employee since 2007, officials said.

Few details about the fatal incident were released by the department, which sent out a notification just before 7 p.m. about the afternoon incident, and an update identifying the prisoner and guard just before 11 a.m. Friday.

"Just after 2 p.m., there was a use-of-force encounter ... between a corrections officer and a 53-year-old African-American male inmate" at the county's Adult Detention Complex, said a PCSD spokesman on Thursday.

"In the wake of that encounter, life-saving measures were administered to the inmate; however, he ultimately succumbed to his injuries. The corrections officer involved was not injured during the encounter and, as standard protocol, this incident is being investigated by Pima County Sheriff's Department's Criminal Investigations Division," said Deputy Daniel Jelineo.

The department released the identities of Hubert and Maxwell on Friday morning, after the dead man's family was notified.

Jelineo said that "it is important to note" that corrections officers at the jail have "limited Force Options" including "officer presence, verbal communications, soft empty hand control techniques, pain compliance techniques, oleoresin capsicum [pepper] spay, and hard empty hand control techniques."

Jelineo said that the department's "investigation is ongoing." Hubert has been placed on administrative leave, the standard protocol after a fatal incident, he said.
